The fine line between AI governance and surveillance in insurance

As AI becomes embedded into enterprise risk management, organisations are discovering that oversight at scale is no longer optional. From insurers to critical infrastructure providers, AI is increasingly used to monitor internal communications, surface conduct risks and identify emerging threats across complex digital environments. 

Yet as oversight capabilities expand, so too does an uncomfortable question; when does AI-driven monitoring cross from governance into surveillance? 

The answer has less to do with the sophistication of the technology, and more to do with how oversight is designed, explained and governed. 

Oversight is no longer a back-office function 

Digital collaboration tools have transformed how work happens. Decisions that once took place in boardrooms or recorded meetings now unfold across chat platforms, mobile devices and ad hoc video calls. For regulated industries such as insurance, these conversations increasingly carry legal, financial and ethical weight. 

This shift has prompted regulators and boards to demand stronger visibility into operational behaviour. Regulatory and legislative change remains one of the top global business risks, underscoring the growing expectation that firms can evidence control over how decisions are made. 

AI offers a way to address this complexity. By analysing large volumes of unstructured communication data, it can surface patterns and anomalies that would otherwise remain invisible. But it is important to remember that greater visibility alone does not equate to better governance. 

The surveillance paradox 

AI-driven monitoring is often justified as a means of reducing misconduct, improving compliance and protecting customers. In practice, however, poorly governed surveillance can introduce new risks. 

When employees do not understand what is being monitored, why it matters, or how insights are used, oversight quickly loses legitimacy. The result is often behavioural distortion. Conversations move to unmanaged channels, context is lost and risk increases rather than decreases. 

Regulatory reviews have already highlighted this gap. The UK Financial Conduct Authority has noted that while firms may collect extensive communication data, fewer can clearly demonstrate how monitoring supports good outcomes rather than simply fulfilling a control requirement. 

This exposes a fundamental truth, that oversight without clarity erodes trust, and trust is a prerequisite for effective governance. 

AI governance as the real differentiator 

As organisations move beyond basic keyword searches towards more sophisticated behavioural analysis, AI governance is emerging as the defining challenge. Systems that flag interactions or surface risk must be explainable, auditable and proportionate to the threats they are designed to manage, particularly as their influence on decision-making grows. 

In high-impact use cases, where the consequences of failure are significant, it is increasingly difficult to justify governance frameworks that do not prioritise transparency, accountability and meaningful human oversight. Enterprises must be able to clearly articulate trigger logic, contextual evaluation, decision ownership and bias controls. Without this clarity, AI oversight shifts from governance to an unaccountable form of control. 

Designing oversight into organisational systems 

Rather than being achieved by layering monitoring tools onto existing workflows, effective AI oversight emerges when governance is embedded directly into the systems people already use, with a clearly defined purpose and explicit boundaries. This approach not only improves adoption but also strengthens trust in how oversight is applied. 

A contextual approach to monitoring is essential, given that not all communication carries equal risk. Governance frameworks should therefore prioritise behavioural signals such as sudden shifts in communication patterns, the use of informal channels for sensitive decisions, or unusual interaction dynamics, which often offer more meaningful insight than the content of any single message. 

Throughout this process, maintaining human judgement as a central pillar remains critical. While AI can surface signals at scale, interpretation, escalation and final decision-making need clearly assigned ownership. As highlighted in PwC’s 2025 insurance outlook, board-level accountability and well-defined responsibility frameworks become critical as AI is increasingly embedded in operational decision-making. 

When oversight is treated as a core governance capability rather than a compliance overlay, it becomes more credible, defensible and ultimately more effective. 

Looking ahead 

The future of AI-driven oversight will be defined by how responsibly organisations use it. Surveillance designed without transparency or proportionality undermines culture and weakens control. Oversight designed with governance in mind strengthens both. 

For insurers and other regulated enterprises, the challenge is how to monitor in a way that reinforces accountability rather than fear. 

When oversight is built on clear intent, explainable systems and human accountability, it evolves from a defensive mechanism into an institutional safeguard. In that shift lies the difference between AI that controls behaviour, and AI that upholds integrity.
