Nursing home and elder abuse specialist law firm alleges pattern of missed red flags and inadequate care culminated in deadly infection at for-profit facility
CLEVELAND–(BUSINESS WIRE)–Michael Hill Trial Law, a nationally recognized litigation firm specializing in nursing home neglect and elder-abuse cases, has filed a wrongful-death lawsuit against the operators and corporate owners of Windsor House at Canfield on behalf of the Estate of Judy Marsh.
According to the complaint, Marsh, 75, lived independently before being hospitalized for pneumonia in December 2024 and was discharged to Windsor House at Canfield for short-term rehabilitation. At admission, she had no pressure wounds. During the next three months, the facility failed to follow required two-hour turning and repositioning orders, left Marsh in soiled diapers for prolonged periods, and documented “no open areas” despite worsening wounds.
Within weeks, Marsh developed a full-thickness Stage IV pressure ulcer exposing muscle and bone that progressed to osteomyelitis and became infected with E. coli. By March 24, 2025, the wound measured 246 cm² (about 38 square inches) and 3 cm deep. Marsh died on April 6, 2025. Her death certificate lists sepsis due to decubitus wounds.
“This case reflects an avoidable and incomprehensible breakdown in basic care,” said attorney Michael Hill, who represents the family. “Our complaint alleges that a profit-driven business model led to chronic understaffing, and that Judy Marsh paid for that corporate decision with her life.”
The lawsuit was filed in the Mahoning County Court of Common Pleas, Ohio, and a complaint can be found here.
