Max Cash to Appeal Trademark Ruling: President Fred Winchar Says, “This Fight Is Far From Over”

SCOTTSDALE, Ariz., April 8, 2025 /PRNewswire/ — Tradition Media Group, LLC, the parent company of Max Cash, announced today that it will appeal a recent ruling by the United States District Court for the Northern District Of Illinois, which canceled its federally registered trademarks for “MAX CASH” and “MAXCASH.”

The court’s decision came in response to a legal challenge from US Bank National Association, which began using the “Max Cash” name on one of its credit cards years after the Trademark Registration rights for the marks “MAXCASH” and “MAX CASH and Design,” along with the common law rights in the marks “MAX CASH” were acquired by Traditional Media Group for consumer loan brokerage services.

Fred Winchar, President of Max Cash, issued the following statement regarding the ruling on March 27th, 2025:

“This decision is devastating. Not just for our company, but for small businesses everywhere that work hard to build something meaningful. We’ve been using the Max Cash name since 2009. We built this brand from scratch, with integrity and a commitment to helping people in financial distress. For a billion-dollar bank to swoop in, use our name without permission, and then erase our trademark rights in court is hard to believe- and even harder to accept.

Make no mistake, this is a David vs. Goliath situation. US Bank threw the full weight of its legal team and resources at us, a much smaller business, knowing we’d struggle to keep up. But we did. And we’re going to continue to fight this, because the truth matters and so does the name we’ve spent over 15 years building. The court ruled that our mark was ‘descriptive and lacked secondary meaning,’ but we believe the evidence tells a different story.

Over 20 million visitors have applied for title loans, personal loans, and other financial products through Max Cash. Consumers know our name because of the services we provide and the trust we’ve earned for over a decade.

We respectfully disagree with the court’s ruling and are appealing this decision to ensure our voice- and the voices of small businesses like ours- are heard. We will not let this ruling define us.
