Local Personal Injury Law Firm Wagner Reese Serves Notice of Claim on School District for Hiring and Retaining Alleged Sexual Predator Brittany Fortinberry

INDIANAPOLIS–(BUSINESS WIRE)–Wagner Reese, an Indiana personal injury law firm, has recently served an Indiana Tort Claim Notice against the Metropolitan School District of Martinsville alleging the District negligently hired and retained sexual predator Brittany Fortinberry. Attorney Jason Reese is representing one of the 13 year old male student victims of Brittany Fortinberry.


On March 26, 2025, Attorney Jason Reese mailed an Indiana Tort Claim Notice against the Metropolitan School District of Martinsville, alleging that a male student was molested and sexually abused as a result of the Districtā€™s negligence. Mr. Reese explained that his clientā€™s goal is to prevent this type of abuse from happening to other students in the future.

According to court documents, at least 10 male victims between the ages of 13 and 16 have accused Brittany Fortinberry of supplying them drugs, engaging in sexual activity including group sex, soliciting explicit photos, and sending explicit photos to the minors.

Brittany Fortinberry has recently been charged in Morgan County with 10 counts of child molestation, eight counts of dissemination of matter harmful to a minor, five counts of contributing to the delinquency of a minor, and one count of sexual misconduct with a minor. These charges are in addition to charges previously filed that included three counts of sexual misconduct, one count of dissemination of matter harmful to a minor, and one count of contributing to the delinquency of a minor.

Our preliminary investigation suggests that the school districtā€™s administrators knew about inappropriate behavior by Ms. Fortinberry but still chose to hire her. When her abuse became known to the district, school officials neglected to timely report the abuse to proper authorities, terminate her employment, and alert parents.ā€
