JACKSONVILLE, Fla.–(BUSINESS WIRE)–Goldberg & Rosen, P.A. and Kutner Personal Injury have filed a lawsuit on behalf of William Grullon and Sheila Feliciano, whose 18-month-old daughter Vianca suffered a catastrophic brain injury after a 2024 Sea-Doo Switch flipped end-over-end while in use at Black Creek Marina in Clay County, Florida.
The complaint, filed in Duval County Circuit Court, names Bombardier Recreational Products (BRP), the Canadian manufacturer of Sea-Doo vessels, and Jacksonville Power Sports, the Florida-based seller. The lawsuit alleges that the Sea-Doo Switch was inherently dangerous due to design flaws, including susceptibility to front overload and water evacuation failure, leading to a higher risk of capsizing. When the vessel unpredictably flipped, 18-month-old Vianca was trapped for nearly 20 minutes without oxygen, sustaining life-altering anoxic brain injury.
“When you see this type of accident, it shocks the conscience, and it makes you wonder how many other people are going to be injured or maimed by this design which is clearly defective,” said attorney Tyson Kutner.

The nationwide recall issued by BRP on February 18, 2025, for all 2022–2025 Sea-Doo Switch models comes on the heels of the February 6, 2025, press conference held in Jacksonville, FL, by the attorneys representing the family. The recall acknowledges the risk of capsizing due to front overload, which is the same danger that caused the Grullon incident. BRP requires repairs, including sealant application, updated warning labels, and safety guide revisions.
