
Artificial intelligence has arrived in the practice of family law—not as a distant possibility but as a present reality. From legal research platforms to financial document analysis tools to AI-powered draft agreement generators, the technology is reshaping how divorce attorneys work. Law schools are racing to integrate AI literacy into their curricula. State bar associations have issued ethics guidance at a record pace. And a small but growing body of academic research is beginning to map both the genuine benefits and the serious risks of deploying AI in divorce and family law proceedings.
For divorcing families in New Bedford and across Massachusetts, this technological shift has direct implications—for the quality of the legal services they receive, the accuracy of the research and documents produced on their behalf, and the ultimate fairness of the outcomes they reach.
What AI Is Actually Doing in Divorce Practice
The popular imagination of AI in law tends toward dramatic images—robot judges, automated verdicts, algorithmic custody decisions. The reality is simultaneously more mundane and more consequential. AI is being deployed primarily in three areas of divorce practice: legal research, financial document review, and document drafting.
Legal Research
Generative AI tools, including those built into major legal research platforms like LexisNexis and Westlaw, allow attorneys to query legal databases in natural language and receive synthesized responses with supporting citations. In a high-volume family law practice, this capability can reduce research time from hours to minutes—enabling attorneys to serve more clients at lower cost and respond to novel legal questions more rapidly.[1] For families in under-served communities like New Bedford, where access to affordable legal services has historically been limited, this efficiency dividend has genuine equity implications.
Financial Document Review
Divorce cases often involve the analysis of years of bank statements, tax returns, retirement account records, credit card statements, and business financials. This work has historically been among the most time-consuming and expensive in family law practice. AI-powered document analysis tools can now process hundreds of pages of financial records in minutes, flagging inconsistencies, identifying hidden accounts, and structuring data for settlement negotiation. Researchers note that this capability is particularly valuable in cases involving financial abuse, where one spouse has deliberately obscured the financial record.[2]
Document Drafting
AI tools can generate draft separation agreements, parenting plans, and financial disclosure statements based on the specific facts of a case. These drafts can serve as efficient starting points for attorney review and client negotiation—compressing the drafting phase that often consumes significant billable hours in both litigated and mediated divorce proceedings.[3]
The Hallucination Problem: What Academic Research Documents
The most thoroughly documented—and most serious—risk of AI in legal practice is the phenomenon of “hallucination”: the tendency of large language models to generate confident, plausible-sounding outputs that are factually false. In general conversation, a hallucinated answer is an inconvenience. In legal proceedings, it can be a catastrophe.
A landmark empirical study by Magesh and colleagues at Stanford, published in 2024, systematically evaluated the hallucination rates of leading AI legal research tools—including products from LexisNexis, Thomson Reuters, and others—and found that even the most carefully engineered platforms produced hallucinated or inaccurate responses in a meaningful fraction of queries.[4] The study found that tools which claimed to be “hallucination-free” in their marketing materials did not consistently meet that standard in empirical testing.
Documented case: In one widely reported incident that prompted Chief Justice John Roberts to address AI in his 2023 annual report on the federal judiciary, a New York attorney submitted a legal brief citing multiple cases generated by ChatGPT—cases that did not exist. The attorney faced sanctions, and the incident became a touchstone in legal AI ethics discussions nationwide.[4]
In family law, where outcomes turn on jurisdiction-specific statutes, the equitable distribution factors of a particular state, and the specific facts of the case before the court, the hallucination risk is especially acute. Massachusetts divorce law has its own distinctive features—the broad asset division authority of Chapter 208, Section 34; the treatment of premarital property; the specific QDRO requirements for Massachusetts public employee pension plans—that a generalist AI tool trained primarily on national legal data may misstate or miss entirely.
Bias in AI and Family Law: The Research Concern
Academic researchers have raised a more systemic concern beyond hallucination: the potential for AI systems trained on historical legal data to encode and perpetuate existing biases in family law outcomes. A 2024 paper in Discover Artificial Intelligence examining the integration of AI into legal practice specifically flagged child custody disputes and divorce settlements as high-risk areas for algorithmic bias—noting that AI systems trained on historical case outcomes will reproduce the distributional patterns of those outcomes, including any systematic disparities they contain.[5]
This concern is not theoretical. Research on gender inequality in divorce proceedings has documented systematic disparities in judicial outcomes that have historically disadvantaged women in asset division and career sacrifice recognition.[6] An AI tool trained to predict “likely outcomes” based on historical case data would reproduce those disparities—not correct them. For attorneys using AI-generated outcome predictions to advise clients on settlement strategy, this embedded bias could quietly tilt negotiations in ways neither party nor their counsel would recognize.
The Equity Question: Access vs. Accuracy
There is a genuine tension at the heart of AI’s role in divorce law that researchers have begun to examine carefully. On one side: AI tools have the potential to dramatically reduce the cost of legal services and expand access to quality representation for families who cannot afford traditional attorney fees. Harvard Law School’s David Wilkins, one of the leading academic commentators on legal technology, has noted that generative AI is making legal information more interactive and accessible in ways that could meaningfully democratize access to the legal system.[1]
On the other side: the accuracy risks documented in empirical research fall most heavily on the clients least equipped to detect them. A well-resourced client with a careful attorney who reviews every AI output has meaningful protection against hallucination and bias. A client who uses an AI tool directly—or whose attorney relies on AI outputs without adequate review—has far less. Research on law students’ and practitioners’ use of AI found that over-reliance and insufficient verification remain widespread concerns, particularly among users who are newer to both the law and the technology.[7]
What AI Cannot Do: The Irreplaceable Human Dimensions
Perhaps the most consistent finding across the research literature on AI in law is the identification of what the technology cannot replicate: the contextual judgment, emotional intelligence, and ethical responsibility that effective family law practice requires. Contini and colleagues, writing in a 2024 peer-reviewed analysis of AI in judicial proceedings, argued that family law involves precisely the kind of “emotive-cognitive” deliberation—weighing incommensurable values, attending to individual human circumstances, exercising moral judgment—that current AI systems are structurally unable to perform.[8]
A parenting plan is not a document that can be optimized algorithmically. It is the scaffolding of two children’s childhoods—built from knowledge of their specific personalities, needs, school schedules, extracurricular commitments, and the particular dynamics of their family. No AI trained on aggregate case data can know what a particular family needs. Only the people who know that family can.

What Divorcing Families Should Ask Their Lawyers
Given the rapidly evolving landscape of AI in family law practice, divorcing families are well-served by asking their attorneys direct questions about how AI is being used in their case. Specifically: Is AI being used for legal research, and how is that research being verified? Are financial documents being processed through automated tools, and what human review is applied to the outputs? Are any draft documents AI-generated, and what is the attorney’s review process before those drafts are finalized?
These are not skeptical questions—they are informed ones. AI that is used carefully, with appropriate verification and human oversight, can genuinely improve the quality and affordability of legal services. AI that is used carelessly is a source of serious risk in proceedings where accuracy matters enormously and errors can follow families for decades.
For families in New Bedford and the surrounding Bristol County and Southeastern Massachusetts communities, choosing a divorce professional who understands both the capabilities and the limitations of these tools—and who brings genuine human judgment to the work—remains the most important decision in the process.
