The EU AI Act provides a risk-based classification model, categorising AI systems into four tiers: minimal, limited, high, and unacceptable risk. UK businesses providing AI services to the EU must assess their AI applications against these classifications.

Compliance involves undergoing conformity assessments (internal or by external notified bodies), establishing risk management systems, providing high transparency, and enabling human oversight. Exceptions exist for narrowly scoped tasks that supplement rather than replace human decision-making.
Unacceptable risk systems are outright banned due to the threat they pose to fundamental rights, safety, or democratic values. Prohibited applications include social scoring systems that penalise individuals for their behaviour or beliefs, real-time biometric surveillance in public spaces (with narrowly defined exceptions), manipulative or subliminal AI designed to distort behaviour, and technologies exploiting vulnerable populations. Other prohibited uses involve emotional inference in sensitive environments like schools and workplaces, and biometric categorisation that infers sensitive attributes such as race or religion. Criminal profiling based solely on personality traits or prior behaviour is also banned.
This tiered approach ensures that regulatory scrutiny is proportionate to the potential harm or societal impact an AI system might cause.
For example, high-risk applications, such as AI used in healthcare, financial decision-making, and autonomous vehicles, are subject to the most rigorous oversight.
A financial services firm employing, for instance, AI for credit scoring needs, would need to ensure compliance with requirements for transparency, fairness, and data privacy. Failure to adhere to these standards could result in severe penalties, reputational harm, and loss of access to the European market.
Meeting regulations
